Nirav Modi’s 5-Day Trial For Extradition Begins On Monday

New Delhi: The five-day extradition trial of fugitive businessman Nirav Modi will begin on Monday and conclude on September 11 in the Westminster Magistrates Court, United Kingdom (UK).
Nirav Modi has been currently lodged in Wandsworth prison in London since he was arrested in May, Last year. The diamond merchant is fighting against the extradition charges related to the fraud and money laundering of Rs 11,000 crore from Punjab National Bank.
Amidst the coronavirus pandemic, District Judge Samuel Goozee has directed Nirav Modi to appear from a room in the Wandsworth Prison located in south-west London along with social distancing. The five-day hearing is expected to conclude on Friday.
Justice Gooze has been presiding from the first extradition of the case in May after the case was brought by the Indian government which was represented at Westminster Magistrates’ Court in London by the UK’s Crown Prosecution Service (CPS). The Indian government has also submitted an additional ‘corroboratory evidence’ against Modi. After which the upcoming hearings are also marked for completion.
The hearing will also deal with an additional extradition request, made by the Indian authorities and certified by UK Home Secretary Priti Patel. The charges which will be added are, “causing the disappearance of evidence” and intimidating witnesses or “criminal intimidation to cause death”.
According to the case by the Indian government, Nirav Modi and his diamond R Us, Solar Exports and Stellar Diamonds obtained loans without mentioning credit facilities, requisite cash margin, without proper documentation and without paying a proper commission.
The documents submitted in the fraud case of Nirav Modi also refers to several points of law, objections and rulings which were made in Vijay Mallya case as the defence from Modi’s side also raised similar objections for extradition.
The CPS also said that there is no evidence which “justifies a departure from the approach taken in Mallya” on the issue of lack of prima facie case. The pieces of evidence submitted by India or on the sovereign assurance by Ministry of Home Affairs prove that there are no risk human rights in the Mumbai jail.
Modi also offered to raise bail security to four million pounds. The case has already rejected his plea for bail four times on the ground that he posed a risk and he may tamper evidence and witnesses connected to the case.
