Sushant’s Cook Seeks Rs 10 Lakh For ‘Illegal Detention’: SSR Probe

Mumbai: Dipesh Sawant, the cook of late actor Sushant Singh Rajput, filed a writ petition in the Bombay High Court, challenging his arrest by the Narcotics Control Bureau (NCB) in an drugs case as illegal.

He also demanded Rs 10 lakh as compensation from the government.

Sawant had been granted bail on October 7 after he was arrested by NCB on September 5 for his alleged role in the procurement of drugs involving the actor’s death in his Bandra apartment on June 14.

In his petition, he claimed the arrest by NCB was illegal which violated his fundamental rights, including those under Articles 21 (Right to life with dignity) and 22 (Right of arrested or detained individual) under the Constitution of India.

Advocates Rajendra Rathod and Aamir Koradia said Sawant was produced for remand before a holiday remand court at 1.30 pm on September 6, after more than 36 hours of his arrest.

It said the NCB had violated Supreme Court’s guidelines by not producing Sawant before the court within 24 hours of his arrest.

He also demanded disciplinary actions to be taken against the NCB officers.

A division bench of Justices S S Shinde and M S Karnik adjourned the hearing of the case by two weeks to allow Additional Solicitor General Anil Singh, representing the NCB, to appear and respond to the petition.

While granting bail to Sawant on October 7, Justice Sarang V Kotwal had observed that there was no sufficient prove to show that he was a part of drug peddling chain as he never sold drugs to earn profit.

The court had further observed that Sawant was doing only according to his “employer” (Sushant) and thus, he did not commit any such offence.

The high court will hear Sawant’s plea against illegal arrest on November 6.
